5. ELIGIBILITY

To use Nyonje, you must:

• Be at least 18 years old, unless applicable law allows otherwise;

• Use the platform for lawful purposes.

If you create an account on behalf of a business or organization, you confirm that you have authority to represent that business or organization.

9. SERVICE LISTINGS

Service providers must ensure that their listings are:

• Truthful;

• Current;

• Legally permitted;

• Published in the correct category;

• Clearly described;

• Properly priced;

• Supported by appropriate images where applicable;

• Associated with accurate business or service information.

Where applicable, listings should include:

• A clear title;

• Accurate description;

• Relevant image;

• Price or pricing information;

• Business or service address;

• Correct category;

• Accurate contact or booking information.

Service providers must update their listings when information changes.

In particular, service providers should update:

• Address;

• Price;

• Availability;

• Contact details;

• Services offered;

• Business status.

Nyonje may remove or restrict listings that are:

• False;

• Misleading;

• Illegal;

• Incomplete;

• Fraudulent;

• In the wrong category;

• Dangerous;

• Abusive;

• In violation of these Terms.

10. VENDOR AND SERVICE PROVIDER RESPONSIBILITIES

Vendors and service providers must:

• Provide lawful services;

• Be honest about qualifications and experience;

• Possess required licenses where applicable;

• Comply with applicable professional regulations;

• Provide accurate prices;

• Communicate professionally;

• Arrive on time where applicable;

Verification badges, ratings, reviews, or other trust features do not constitute an absolute guarantee of a person's conduct, qualifications, or service quality.

28. FORCE MAJEURE

Nyonje will not be responsible for delays or failures caused by circumstances beyond reasonable control, including:

• Fires;

• Internet outages;

• Cybersecurity incidents;

• Government actions;

• Civil unrest;

• Pandemics;

For users in Kenya, applicable Kenyan laws may apply where required.

For users in Brazil, applicable Brazilian laws and mandatory consumer-protection and data-protection rights may apply where required.

Nyonje may establish a specific legal entity, registered office, governing law, and dispute-resolution forum as the business develops.

Important: Nyonje should update this section once the legal entity, registered office, and principal jurisdiction of the business have been formally determined.

31. SEVERABILITY

If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

32. NO WAIVER

If Nyonje does not immediately enforce a provision of these Terms, this does not mean that Nyonje has waived the right to enforce that provision later.
